Sealed Bids for the construction of Contract No. 2 – Force Main Upgrade will be received, by the Town of Exeter, at the office of the Town Office Building (10 Front Street, Exeter, NH, 03833, until 4:00 PM local time on February 25, 2019.  The bids will remain sealed until the Select Board meeting on February 25, 2019 at which time they will be publicly opened and read.  The Project consists of installing dual 16-inch diameter high density polyethylene force mains from the Main Pump Station to the DPW Campus along Swasey Parkway and Newfields Road (NH State Route 85), one 12-inch high density polyethylene water main from Water Street to the DPW Campus, storm drain improvements, gas utility relocation, road reconstruction and appurtenant work.

Bids shall include lump sum, unit price and allowance items, as indicated on the Bid Form. The Basis of Award is Total Bid.

The Issuing Office for the Bidding Documents is Wright-Pierce (230 Commerce Way, Suite 302

Portsmouth, NH 03801).  Prospective Bidders may examine the Bidding Documents at the following locations:

Bidding Documents may be obtained in PDF format from the Issuing Office at www.wright-pierce.com/projects.aspx.  Non-refundable fees for Bidding Documents are $50.00 per PDF download.

To be considered a responsive Bidder, the Contractor shall have obtained at least one set of Bidding Documents from the Issuing Office.  The Bid will not be awarded to a Bidder unless a record for obtaining at least one set of Bidding Documents exists in the Issuing Office.  To meet this requirement and to establish the record of receipt, a prospective Bidder must obtain Bidding Documents using the name that is to appear on the Bid Form. 

A pre-bid conference will be held at Exeter Public Works Facility (13 Newfields Road, Exeter, NH) John Doyle Conference Room on February 12, 2019 at 2:00 PM.  Attendance and participation is encouraged.

A bid must be accompanied by Bid security made payable to Owner in an amount of 5% of Bidder’s Total Bid price.  No bid may be withdrawn for at least 60 days after receipt of bids unless released by the Owner.  Refer to Instructions to Bidders.

This contract is expected to be funded in whole or in part by the State of New Hampshire Department of Environmental Services (NHDES) Clean Water State Revolving Fund (CWSRF) program and the State Aid Grant (SAG) program.  Neither the State of New Hampshire nor any of its departments, agencies, or employees is or will be a party to this contract.  The word “agency” in the contract documents refers to the NHDES and all other involved funding agencies.

The successful Bidder must furnish 100% Performance and Payment Bonds, and will be required to execute the Contract Agreement within 15 days following notification of acceptance of its Bid.

The successful Bidder must comply with the President's Executive Order No. 11246 entitled "Equal Employment Opportunity" as amended by Executive Order 11375, and amendments or supplements thereto, and as supplemented in Department of Labor Regulations (41 CFR Part 60). 

The successful Bidder must comply with the American Iron and Steel (AIS) requirements of the CWSRF Supplementary Conditions.

The successful Bidder must comply with the Disadvantaged Business Enterprises (DBE) requirements of the CWSRF Supplementary Conditions.  Failure of the successful bidder to complete the pre-award requirements of this program may result in finding that the bidder is non-responsible and therefore not entitled to award of this contract.  The successful bidder must furnish a complete list of sub-bidders, if requested by the Engineer. 

The successful Bidder must comply with Davis-Bacon (DB) and Davis-Bacon Related Acts (DBRA) as stated in the CWSRF Supplementary Conditions.  All laborers and mechanics employed by the contractor and subcontractors on this project shall not be paid less than the prevailing wage rates contained in the wage determination published in the bidding documents.

The Town of Exeter reserves the right to reject any or all Bids, to waive any technical or legal deficiencies, and to accept any Bid that it may deem to be in the best interests of the Town.
